Nigeria’s Data Protection Commission Cracks Down on Global Platforms

Nigeria’s Data Protection Commission (NDPC) has taken a strong stance against global platforms, including Truecaller and TikTok, over their handling of Nigerian citizens’ data.

The Scope of Nigeria’s Data Protection Law

The NDPC, led by Dr. Vincent Olatunji, has stated that entities handling the personal data of Nigerians, regardless of their location, must comply with the Nigeria Data Protection Act (NDP Act) 2023.

  • Dr. Olatunji emphasized that the NDPC’s mandate extends to both local and international entities, making them accountable for data protection.
  • The Commission is also investigating global platforms like Truecaller and TikTok for mishandling Nigerian citizens’ data.

According to Dr. Olatunji, the NDPC has intensified efforts to secure sensitive information within the country’s healthcare system.

Healthcare Data Protection: A Growing Concern

The National Commissioner of the NDPC highlighted the importance of robust data protection measures in the healthcare sector.

“If you reside in Nigeria and process Nigerian data, you are within scope. Even if you are outside Nigeria, once you process the data of Nigerians, you are within scope,” Dr. Olatunji said.

The Commission has established a partnership with the Federal Ministry of Health and Social Welfare to strengthen safeguards for patient information.

Key Components of the Partnership

  1. Strengthening data security in healthcare facilities.
  2. Enhancing data protection measures for patients.
  3. Aligning with President Bola Tinubu’s administration priorities.

The partnership aims to tackle emerging challenges in healthcare data privacy while ensuring the confidentiality, integrity, and security of personal health data.

Expert Opinions and Commitments

The collaboration marked a significant step toward enhancing data security in healthcare, as both parties emphasized the importance of robust data protection measures.

“The health sector is generally sensitive, and the kind of information collected has to do with medical records which could be used to discriminate against anyone seeking to have good healthcare,” Dr. Olatunji warned.
